Parental rights are an integral component of religious freedom. Numerous international treaties recognise and confirm that the family is the foundational unit of society, and that parents have the legal right to raise their own children according to their own religious beliefs and moral values. In short, parental rights are non-negotiable.
South Africa’s 1995 Education White Paper 1 describes parents' choice regarding the kind of education best for their children - which includes the religious basis of that education - as an inalienable right. The White Paper emphasis the particular importance of this right during the early years of schooling. It also affirms the State has a duty to consult parents regarding their children's education and that parents have the right to participate in the governance of schools.
Parental rights are also crucial for ensuring that the best interests of children are upheld. Healthy families, where children are loved and nurtured by their parents, provide children with a solid start in life. For this reason, international law states that neither the State nor society may undermine the cohesion of families. In fact, the State's duty to protect and support families is emphasised. What is means is that no one may drive a wedge between children and their parents.
